Privacy policies and terms for Benosso apps

These Terms govern use of the Benosso WhatsApp Notifier application (“the App”), provided by Benosso İnternet Yazılım İthalat İhracat Ticaret ve Bilgi Teknolojileri A.Ş. (“Benosso”), a company registered in Türkiye (tax no. 1640774681), benosso.com, support@benosso.com. By installing or using the App, the store owner (“the Merchant”) agrees to these Terms.
The App sends WhatsApp notifications for the Merchant’s own orders — a merchant alert, a customer order confirmation, and optionally a cart-recovery message — through the official WhatsApp Business Platform (Meta Cloud API).
Messages are sent with the Merchant’s own Meta credentials and WhatsApp Business account. The Merchant is responsible for obtaining and maintaining that account, its message templates, and any fees Meta charges for message delivery.
The Merchant is responsible for having a lawful basis to message their customers, for complying with WhatsApp’s Business Messaging Policy, and for applicable marketing and privacy laws.
Paid plans include a monthly message allowance shown in the dashboard. Exceeding the allowance pauses sending until the counter resets or the plan is upgraded. Billing is handled by Wix.
Message delivery depends on Meta and on the recipient’s WhatsApp account. Benosso cannot guarantee that every message is delivered or read.
The App must not be used to send spam, unlawful, deceptive or harmful content, or to message people who have not agreed to be contacted.
The App is provided “as is”. We aim for continuous availability but do not guarantee uninterrupted service.
To the maximum extent permitted by law, Benosso is not liable for indirect or consequential damages, or for lost sales, revenue or data. Total liability shall not exceed the fees paid for the App in the three months preceding the claim.
The Merchant may uninstall the App at any time; settings are removed with it. We may suspend access for breach of these Terms.
